Since the Club’s December 1999 circular on this subject the following developments are relevant for ships carrying more than 2,000 tons of oil on bulk as cargo:
CLC 1969 still applies in Malaysia. Contrary to the IMO resolution of November 1999 inviting parties to CLC 1969 not to require ships holding CLC 1992 certificates to obtain additional CLC 1969 certificates (and to accept CLC 1992 certificates as meeting the requirements of CLC1969), the Malaysian authorities nonetheless require CLC 1969 certification for ships registered in CLC 1992 states. to view the required procedure and documentation.) Such certificates will only be issued to vessels intending to call at Malaysian ports.
As an alternative, the Malaysian authorities have indicated that they may be prepared, on production of a 1969 Blue Card, to endorse a CLC 1992 certificate to the effect that CLC 1969 liabilities are also covered. However, it is anticipated that such an endorsement could cause problems for vessels calling at ports of CLC 1992 countries.
