Recent Developments

The number of contracting states to the 1969 CLC continues to diminish while those acceding to the 1992 Protocol increases. The effect of the IMO resolution is to confirm that a 1992 CLC Certificate is acceptable evidence of insurance for vessels calling at 1969 CLC states. Accordingly, a 1969 CLC Certificate should be unnecessary for vessels carrying a 1992 CLC Certificate.

Most 1969 CLC states have accepted this solution with Malaysia being a notable exception. Tankers trading to Malaysia must have a 1969 CLC Certificate and, for tankers visiting Malaysia, the Malaysian authorities are willing to endorse a tanker's 1992 Certificate to the effect that it also covers 1969 CLC liabilities upon production of a 1969 CLC "blue card" (which can be obtained from the Club). However, they are not willing to provide such certificates to tankers not trading to Malaysia.

1969 CLC Certificates can no longer be obtained from Panama and Malta - two countries that traditionally provided this service - since the 1969 CLC has ceased to have effect in both of those countries.
